These terms are an agreement between you and TruePoint Digital ("TruePoint," "we," "us," "our"), based in Arizona, United States. They cover both the truepoint.agency website and the booking and lead systems we build and manage for our clients.
By using this site, submitting a form on it, or subscribing to one of our services, you agree to these terms. If you're agreeing on behalf of a business, you confirm you're authorized to bind that business. If you don't agree, don't use the site or the services.
TruePoint builds booking, deposit, and follow-up systems for automotive businesses — mobile detailers, ceramic and PPF shops, and repair businesses. Depending on the package you choose, that can include a booking page with deposits, appointment reminders, rebooking and follow-up campaigns, missed-call text-back, review requests, and a single place where leads and conversations are tracked.
These systems are built and run on HighLevel (also called Go High Level / LeadConnector), a third-party platform, along with other third-party services for messaging, hosting, and payments. We configure, manage, and support your system. We do not own, control, or operate those underlying platforms.
Nothing on the website by itself creates a contract for services. Your subscription starts when you sign up and pay, or when we otherwise agree in writing on scope and price.
Your contacts, your customer list, your content, and your brand are yours. They don't become ours by sitting in a system we manage.
For 30 days after cancellation you can ask us for an export of your contacts and conversation history, and we'll provide it in a standard format at no charge. After that window we may delete your system and its data, and it may not be recoverable. If the account is under your own HighLevel subscription rather than ours, access is governed by your agreement with them, not by us.
These matter more than the rest of this page, because breaking them can get your phone number blocked and expose you to real legal liability:
Text messaging in the US is controlled by mobile carriers, not by us. A2P 10DLC registration is required before business texts can be sent reliably, and carriers can review, filter, throttle, or block messages at their discretion.
We'll set your messaging up correctly and register it properly, but we can't guarantee delivery, delivery speed, or that a campaign will be approved. Carrier fees, registration fees, and penalties for non-compliant messaging are passed through to you. If your content or your consent practices cause a number to be blocked or a campaign to be rejected, that's on you, not on us.
Your system depends on services we don't control — HighLevel, telecom providers, payment processors, and hosting. Your use of them is also subject to their own terms and policies. We're not responsible for their outages, price changes, feature removals, bugs, or account decisions. If one of them goes down or changes something that breaks part of your system, we'll work to get you running again, but we're not liable for the interruption itself.
Any numbers, examples, case studies, or outcomes we mention — on the site, in a DM, on a call, or in an ad — are illustrative, not a promise. We do not guarantee any specific number of bookings, leads, revenue, or return on investment. Results depend on your market, your pricing, your service, your responsiveness, and how you actually use the system.
Each of us may see the other's non-public business information. Both of us agree to keep it confidential and use it only for the purpose of this relationship. This doesn't cover information that's already public, that you or we already knew, or that the law requires be disclosed.
Use the site honestly. Give accurate information when you fill out a form, and don't attempt to disrupt, overload, scrape, reverse-engineer, or gain unauthorized access to the site or the systems behind it. We may block access to anyone who does.
The website and our services are provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that the services will be uninterrupted, error-free, or that they'll produce any particular outcome for your business.

You agree to defend, indemnify, and hold TruePoint harmless from any claims, damages, fines, penalties, and reasonable legal costs arising from: the content of the messages you send, your customer or contact lists, your failure to obtain proper consent, your breach of the TCPA or other marketing and telemarketing laws, or your breach of these terms.
We may suspend or terminate services if you don't pay, if you use the services illegally or in a way that risks carrier blocking or legal exposure for either of us, or if you materially breach these terms. Where the situation reasonably allows it, we'll give you notice and a chance to fix the problem first. We may also stop offering a service with 30 days' notice, and if we do, we'll refund any prepaid fees for time you don't get.
We may update these terms. The date at the top reflects the latest version. For a material change we'll notify active clients directly, and continuing to use the services after a change means you accept the updated terms.
These terms are governed by the laws of the State of Arizona, without regard to its conflict-of-laws rules. Any dispute will be brought exclusively in the state or federal courts located in Maricopa County, Arizona, and both parties consent to that jurisdiction.
Before filing anything, talk to us first — email or call and give us 30 days to try to resolve it. Most problems get sorted out with a phone call.
These terms, plus any written quote or scope we agree with you, are the whole agreement between us and replace any earlier discussions. If any part is found unenforceable, the rest still applies. Not enforcing a right once doesn't waive it. You may not transfer this agreement without our written consent; we may transfer it as part of a sale or merger of the business. We are independent contractors — nothing here creates a partnership, employment, or agency relationship. Neither party is liable for failures caused by events outside its reasonable control.
